On June 5, 2023, the DOE issued the U.S. National Clean Hydrogen Strategy and Roadmap (Hydrogen Roadmap), providing a comprehensive strategy to advance the production, processing, delivery, storage, and use of clean hydrogen. The Hydrogen Roadmap summarizes the various initiatives contained in both the 2021 Infrastructure Investment and Jobs Act and the 2022 Inflation Reduction Act, including funding and construction of regional clean hydrogen hubs, tax incentives, public-private planning, interagency coordination, and other key areas and opportunities available for low carbon hydrogen-based projects. Thus, attorneys need to recognize the many ways in which such projects are being advanced.
Hydrogen made from renewable or low carbon electricity is key to decarbonizing certain sectors such as steelmaking, fertilizer, and other heavy-duty transportation, among others. Hydrogen also presents opportunities to assist in further decarbonizing the power sector by providing direct generation, energy storage solutions for off-grid electricity, and grid balancing. Thus, counsel must be aware of the legal issues and current trends for hydrogen’s potential role in the electrical grid specifically.
Although the potential benefits of using clean hydrogen in energy and related industries are attractive, the lack (or at least uncertainty) of federal regulations and guidance in certain key areas raises risks for energy companies, utilities, investors, and other stakeholders. Attorneys practicing in the energy and other related sectors must be aware of potential regulatory issues and other legal matters for hydrogen and related product production, application, and usage.
